Mason Carpentry Solutions – Terms & Conditions
1. Definitions
• “The Company” refers to Mason Carpentry Solutions.
• “The Customer” refers to the person, business, or organisation engaging the Company.
• “Works” refers to the carpentry, joinery, installation, repair, and related services agreed between the Company and the Customer.
2. Acceptance of Terms
These Terms & Conditions apply to all quotations, estimates, works, and contracts undertaken by Mason Carpentry Solutions.
Acceptance of a quotation, estimate, invoice, deposit request, or instruction to proceed with works shall constitute acceptance of these Terms & Conditions.
3. Quotations & Estimates
All quotations are valid for 15 days from the date issued unless otherwise stated.
Quotations are based on information available at the time and may be subject to change if additional work, materials, or unforeseen circumstances arise.
Where there are significant fluctuations in the cost of materials outside the control of Mason Carpentry Solutions between the date of quotation and the commencement or continuation of works, the Company reserves the right to adjust the quoted price accordingly. Any such adjustment will be discussed with the Customer before proceeding.
If a quotation is issued before a site survey has been carried out, it is provided as a guide price only and is based solely on the information supplied. A final quotation will be issued following a site visit and may be amended to reflect site conditions, measurements, access requirements, or any other factors identified during the survey.
If a quotation is issued following a site survey, it has been prepared specifically for the Customer's project and shall be regarded as the final quotation, valid for 15 days from the date issued.
4. Deposit & Materials
A deposit of up to 50% of the quoted price may be required prior to the commencement of works. This deposit enables the purchase of materials and the scheduling of labour for the project.
A deposit invoice will be issued when payment is required, and payment should not be made until such invoice has been received.
Mason Carpentry Solutions does not operate credit accounts with suppliers. As such, materials must be paid for in advance, and works will not be scheduled or commenced until the required deposit has been received.
5. Variations & Additional Work
Any variations, alterations, or additional works requested by the Customer that fall outside the original quotation must be agreed before work proceeds.
Additional costs may apply and will be charged at the Company's standard rates unless otherwise agreed in writing.
6. Progress Payments & Project Delays
Where a project cannot be completed in one continuous period of work, or where works are delayed, paused, or interrupted for any reason, Mason Carpentry Solutions reserves the right to issue an invoice for the percentage of works completed to date.
The percentage completed will be assessed reasonably based on labour undertaken and materials supplied.
The remaining balance will be invoiced upon completion of the outstanding works.
7. Payment Terms
Unless otherwise agreed in writing:
• Invoices are payable within 3 days of the invoice date.
• Payment must be made in full without deduction, withholding, or set-off.
• Late payments may incur interest and recovery costs in accordance with applicable legislation.
The Company reserves the right to suspend works where payment terms are not met.
8. Ownership of Materials
All materials supplied by Mason Carpentry Solutions shall remain the property of the Company until payment has been received in full, even where such materials have been installed at the Customer's property.
9. Timescales & Delays
Any stated commencement or completion dates are estimates only and are not guaranteed.
Mason Carpentry Solutions shall not be liable for delays caused by circumstances outside its reasonable control, including but not limited to adverse weather conditions, supplier delays, illness, access restrictions, hidden defects, or changes requested by the Customer.
10. Customer Responsibilities
The Customer shall provide reasonable access to the site, adequate working space, and access to necessary utilities where required.
Any delays or additional costs arising from restricted access, unavailable services, or site conditions not previously disclosed may be chargeable.
11. Existing Defects
Mason Carpentry Solutions shall not be responsible for defects, damage, or failures arising from pre-existing structural issues, damp, rot, infestation, hidden services, or other conditions that were not reasonably apparent during inspection or quotation.
12. Hidden Conditions
Quotations are prepared based on visible site conditions and information reasonably available at the time of inspection.
Where hidden or unforeseen conditions are discovered during the course of the works, including but not limited to rot, damp, infestation, structural defects, concealed pipework, electrical installations, asbestos-containing materials, or other issues not reasonably identifiable at the time of quotation, Mason Carpentry Solutions reserves the right to revise the scope of works and/or the quoted price accordingly.
Any additional work and associated costs arising from such conditions will be discussed with the Customer and agreed before proceeding wherever reasonably practicable.
13. Standard of Work
All works will be carried out with utmost skill and care and in accordance with recognised industry standards.
14. Completion of Works
Minor defects or snagging items that do not materially affect the use, function, or safety of the works shall not constitute grounds for withholding payment.
Mason Carpentry Solutions will rectify any agreed snagging items within a reasonable timeframe following completion.
15. Damage & Liability
The Company maintains appropriate public liability insurance.
Nothing in these Terms & Conditions shall exclude or limit liability where such exclusion or limitation is prohibited by law.
Subject to the above, the Company's total liability arising from any claim relating to the works shall not exceed the total value of the works supplied under the relevant contract.
The Company shall not be liable for indirect, consequential, or economic losses.
16. Cancellations
If the Customer cancels works after acceptance of a quotation:
• The Customer shall remain responsible for the cost of any materials ordered.
• Reasonable costs incurred up to the date of cancellation may be charged.
• Where works are cancelled with less than two working days' notice, Mason Carpentry Solutions reserves the right to charge a reasonable sum to reflect loss of income, including time reserved for the project that cannot reasonably be reallocated.
Deposits used to purchase materials may be non-refundable.
17. Termination
Mason Carpentry Solutions reserves the right to terminate works where:
• Payment terms are not met.
• Site conditions are unsafe.
• Access is repeatedly denied.
• Instructions are inconsistent, unreasonable, or materially alter the agreed scope of works.
Payment for work completed and materials supplied up to the date of termination shall remain due.
18. Complaints
Any complaints should be raised in writing as soon as reasonably possible to allow Mason Carpentry Solutions the opportunity to investigate and resolve the matter promptly and professionally.
19. Statutory Rights
Nothing within these Terms & Conditions shall affect the Customer's statutory rights under applicable law.
